What happens if previous guests won't leave?

A comment on the "cleaning your rental" thread got me wondering. It said they paid for early check in but the folks from the previous week refused to leave at the standard check out time and were 3 hours late getting out. What happens in those instances? Do the realty companies have any grounds for action (i.e. lose a deposit)? How rude would someone have to be to do that to the cleaners and next guests?

This happens more than you know! Since we have to show homes on the turn-over date if they are for sale I run into renters staying later than 10am quite often. I hear things like, "my wife went to the office to turn in the keys" thinking that will give them time to pack up and leave later.

The problem is the rental company will not know unless someone tells them. If the cleaners are not going to get there until noon, for example, no one will know and it probably won't cause any delay for the next renter. But if the cleaners get there at 10am and see cars they just go to the next house to clean and they might do that house last now. It might have been done by 1pm but now it might not be done until 4pm. I recall being asked to go check a house to see if they have left when a cleaner called to report them still there. When I got there around 11am they gave me the "we turned in the keys" answer and I stayed until they left at noon. There is not much you can do. Some are just inconsiderate to others. Sad smiley

If things get real bad, you have article 4 of the NC Vacation Rental Act for Expedited Eviction Proceedings:

ยง 42A-23. Grounds for eviction.
(a) Any tenant who leases residential property subject to a vacation rental agreement under this Chapter for 30 days or less may be evicted and removed from the property in an expedited eviction proceeding brought by the landlord, or real estate broker as agent for the landlord, as provided in this Article if the tenant does one of the following:
(1) Holds over possession after his or her tenancy has expired.
...

Of course, "Expedited" is a relative term. It could still take a couple days to get them out if they truly refused. Thankfully that rarely happens that someone just won't leave.

The lease from the management company I use states a $100 per hour fee will be charged after checkout time. Not sure how the others that required early check in would be compensated. Not sure how often this happens that the same property with a guest not leaving and one request in early checking match up??

Does anyone ever fantasize that TEOTWAWKI occurs while on vacation and we can't leave the house, everyone has to hole-up where they are. Having to survive when all hell breaks loose on the beach with a fishing pole and grill . . . only challenge is the beer supply.

Thought first occurred while vacationing in Corolla and a hurricane came through flooding most of us in Corolla for a while and massive flooding of the Tar river for folks not that far from us.

If the house is a priority house (i.e. the incoming renters paid for early check-in), one would hope the cleaning crew would notify the management office if the outgoing renters have not checked out at checkout time.

Also, FWIW, since I self manage our house, I will generally inquire with my guests as to whether they would be interested in early check-in or late check out, in the event that either is a possibility. Sometimes I find out they're not getting to the island until late, or that they plan on leaving early on check-out day. I share this information with my cleaners and they love when I do this, as it allows them to schedule their crews easier. The housekeeping supervisor was so happy when I mentioned one week that my guests weren't going to be arriving until 6:30pm as they had a particularly high workload that turn day and someone had called in sick. On the flip side, when I know that the cleaning crews won't make it to the house until after noon, I let my renters extend their checkout time for a couple more hours.

This is not something that is easy for PMs to do, but since I have good communication with my guests and our cleaners, I can often work it out.

Im not sure of the exact circumstances but in 2015, we had a Sun-Sun rental on the beach road. We sat on our deck and watched some people 4 doors down making a very hasty and comical departure at roughly 1 p.m. on Saturday. ( I mentioned it in my trip report that year..they were something to behold the entire week actually lol) Shortly after they literally peeled out in a cloud of dust the Kitty Hawk P.D. pulled in and walked around the house, onto the decks, peering inside before they left. I do not know if the PM called them or what but cleaners arrived within minutes.

This thread made me think of something as a 'Renter'. Just to avoid traffic and to try to get home to take care of unpacking, etc., we always leave very early before the rental office opens. I guess if it makes someone's life a little easier, whether it be the cleaners, rental office, or next renters, I guess I should let the rental office know this so that they can plan accordingly.

I've thought about calling the PM on our way out of town since we're usually out by 8am (9am this year since I had a little too much fun on Friday night smiley with shades ). That way they could go ahead and get the cleaning crew in. I always change my mind because I don't want to end up bothering the PM on a busy turnover day, even with positive info. thoughts?

You can always ask on check-in if they'd like to know. I imagine it would be particularly helpful for them to know if it's significantly early, say 7am or earlier, and you are able to notify them in advance. After that, I suspect it doesn't matter as much, say by 8:00am, as people are leaving left and right to get a jump on traffic.

Likewise, if you know you're not getting to your rental until later, say check-in time or later, I'm sure they'd love to know that too, so they can knock out the other houses before your.

If using electronic key, I text our company on the way out, even at 6 am. When they get in, it may help in some way to know the house is clear. Just a courtesy. This year, we rented from Outer Banks Blue and got a nice message wishing us safe travels home. They were a very responsive agency to work with - 2nd year in a row.

That is super cool!

This was our first trip with keyless entry and they had us just type in 123456 on the keypad and it made a little noise and that was that. But I do wonder how successful it is at alerting them since they sent us the text that our code was active at 5:30 on check in day but the code didn't work for almost another hour.

123456? That's amazing! I've got the same combination on my luggage!

We've never had a key less entry house, so we always had to drop off the keys. That seemed like sufficient notice that we are out. We usually head out early.

I'll never understand the inconsiderate people. I couldn't be that way, even if I tried. Sometimes I think we're to considerate, but I like it that way. It's worked well for us so far.

We've never had a key less entry house, so we always had to drop off the keys. That seemed like sufficient notice that we are out. We usually head out early.

Most of the owners here would probably agree that we'd be quite happy with our season Booked by 100% OBXCers (with a few unmentionable exceptions perhaps). No one comes here is (or at least admits to) trashing houses, throwing parties, and then demanding a 100% refund because they saw a spider under the house and now they're experiencing mental anguish.

They would have to, but then what? Really, then what could you do? Really, what to get done in a couple,hours? Don't say police or eviction. Those can take hours if at all.



Use some customer service skills and remind them of the checkout time, ask them if there is something they need help with. Take the high ground. If they get sh!tty with the supervisor, they should be advised of their obligation to vacate the premise and inform them if they don't vacate in x amount of time that the expidited eviction process will begin. For most people, just a "talking to" is enough to nudge them on. I'm sure for many of these folks, they've taken their time in the past and no one ever said anything to them about it, so they continue the behavior.

Unfortunately there are too many rental companies that are way too happy to take these dumb rednecks money again in the future and don't want to hurt their feelings, regardless of how they treat the property or fail to follow the rules.
