You can’t get a new job

I’m interested in hearing opinions outside of my normal sphere.

There’s a level II trauma center in Wisconsin that had 7 out of 11 personnel put in their notice to quit back in December after getting a 50-75% pay raise by a competitor.

This is basically the entire interventional radiology department.

The CEO of the hospital refused to match their competitor’s offers and has now sued for an injunction in state court to not allow these healthcare workers to start their new jobs.

The CEO was granted the injunction.

Is this a violation of the 13th Amendment?

What do you guys think?

If these folks all leave their current job for the same job at much higher pay, this hospital will lose their trauma center accreditation.

Is it ok to stop folks, legally, from accepting a better paying job?

I'm not sure how a court can have any say in this matter. If they do, that seems to me a violation of the individual's right to work where and for whom they want. And what's to stop them from just not showing up to work if the injunction is upheld? And do you really want people that don't want to work for you to be there? I'd feel sorry for the patients, although hopefully the staff wouldn't short change the level of care because of their employer.

The judge admitted he didn’t have the power to compel the workers to continue working for their previous employer after they resigned.

His injunction expired last night and the seven workers will start their new jobs tomorrow.

Absolutely no idea. I assume that would be up to the courts. The argument I read was that by hiring away that staff at a higher wage you have caused damages to the corporation that lost the employees in the form of lost profits. That loss of profits could be recouped in a civil suit by the courts awarding damages.

No idea if that would fly, legally, but that was how it was explained to me.

I agree. I was horrified that a judge even granted a temporary injunction to stop private citizens in a private corporation from starting new private employment.

But what I don’t know about labor law and precedent in regards to private employment and how that factors in with the 13th Amendment — I could just about squeeze that in the Grand Canyon.

i just lost my favorite coworker to a better paying job plus bonuses. Hes pulling in about a 1000 extra in bonuses a week. People go where the money is. Simply nothing will stop it. We are all looking at other jobs now

I have had two employees come to me in the past 3 months asking for a crazy number or they quit.

I decided to save one of them, the other I wished them good luck.

With that said, hiring right now is very difficult, to get a talented person you are paying 10-15% more minimum than you were paying a year ago.

However, the only way I could see this being enforceable is if the employees had signed a contract for x number of years' service and they left before the contract was up. Then, depending on the state laws, they could potentially be sued for breach of contract.

My wife is a nurse and she has told me some oddball stories that she's witnessed over the years as far as what hospitals are and are not able to hold them to. She once worked with a nurse who got caught swiping pain killers and abusing them. They ordered this nurse to complete a rehab program and gave her job back once she finished. Another one had a complicated pregnancy and missed too much time in the eyes of management. She was let go. Go figure...

Yes we had 2 similar drug rehab then ur job back. Neither one returned because of the gossip and mistrust.
