Penis,
don't you want to post this on the OBC Cafe forum too? Or are two posting of the same link adequate?

Squishy,

Surely you can find something better to complain about; however you know that your retention is limited and reading it twice is good for ya.

Waiting for the SELC to check in and see what progress you have made on your claim that you can find where they were reminbursed by DOI for CHNS lawsuits.

RE: Vandals at CHNS Cape Point Campground

Penis,
chew on this for a while.
And I quote:

"The Equal Access to Justice Act (EAJA) was put in place in 1980, and was designed to help small businesses protect themselves against lawsuits from environmentalists, and a predator EPA. Today, huge Leftist environmental groups are using the EAJA to secure mammoth fees for its attorneys by initiating lawsuits against big and small entities who are targets of government regulations and other green encroachments. It’s a slick collusion between government and environmentalists, a sick joke on you and me.

According to this Daily Caller article by Jacob Laskin (please read it all here), the Government Accountability Office (GAO) is not ‘accountable’ for keeping track of these fees:

Still, we have some clues about the amounts at stake. In an August 2011 study, the GAO reported that between 2003 and 2010, the Treasury Department paid $14.2 million in attorneys’ fees just to those plaintiffs suing the Environmental Protection Agency (EPA).

That means that the total for all federal agencies is in the tens of millions of dollars every year.

EAJA thus serves as a hugely expensive vehicle of collusion between the government and environmental groups to advance the environmental movement’s political agenda on the taxpayer’s dime.

Since the general rule is that the loser pays the winner’s attorneys fees, and government is “paying,” we can assume we are winning – can’t we?

Congress passed several pieces of legislation designed to make it easier for small businesses to challenge the government. One was the EAJA, which ordered federal agencies to pay the legal costs of firms that successfully challenged their rulings.

But that’s NOT the story. This is the story:

Before long, some of the country’s most powerful environmental law firms were availing themselves of the EAJA to force the government to bend to their political agenda and pay their legal fees — sometimes as much as $750 an hour — in the process. The result was a gross perversion of the political process, paid for by the unknowing American public…

The incestuous relationship between the government and environmental groups extends beyond litigation.

In addition to subsidizing their lawsuits, the government is also a leading sponsor of these groups, to the tune of hundreds of millions of dollars.

As David Horowitz and I report in our new book, The New Leviathan, between 2008 and 2010, 247 left-wing environmental groups received almost $569 million in federal grants. During the same period, conservative and free market-friendly environmental groups also received government grants, but a comparatively piddling $728,000…

Similarly, the Environmental Defense Fund (EDF), another major environmental group, has sued the EPA numerous times over the past decade. But that hasn’t interrupted the group’s cash flow: the government has given the EDF $2.76 million in grants during that period.

In a case which the EPA lost against the US Navy, EPA attorneys went back to court to ask for (and received) a higher rate of compensation for the work they did, and more for outside expert attorneys.

In other words, the NRDC contended that the government was not paying its lawyers enough to file suit against it. The NRDC was eventually awarded most of the reimbursement it sought.

Operative: “…not paying its lawyers enough to file suit against it.” !!!

It takes no imagination to understand what these millions, maybe billions are used to do to against the case for smaller government, lower taxes and a better economy:

Instead, the money has been spent enriching what is anything but an endangered species in America: trial lawyers.

Is there any single, honorable thing our Government is engaged in at this time? Is there anything our Government does not mismanage, either ineptly and/or purposefully/criminally at this time? Page 1 of the article is linked above."

End quote.

Of course you wouldn't admit the facts of the matter: The losing party in litigation pays the legal fees of the victors. Although the SELC has an operating budget of over 17 Million Dollars from donations and grants, they pay their attorneys from the winnings of litigation. Criminal. Criminal because in the case of access litigation, the people paying the tab were you and me.
I'm glad to see that even though you don't pay to use CHNSRA, you helped to pay the legal fees of the SELC attorney's out of your taxes.

What a bunch of manure ... STAY FOCUSED ... you said that you could prove that the DOI has paid SELC for law suits at CHNS. Until you can do that keep on posting stuff like the above ... it makes me laugh Laughing smiley

RE: Vandals at CHNS Cape Point Campground

Do you think there may be an issue with the cost of these enviro extortion suits when they (DOI) lobbied for and succeeded in getting legislation that says they do not need to divulge the taxpayer money they burn on said suits? Laws made by elected lawyers and designed to line the pockets of their pond scum fraternity brothers with tax money from the 60% of us who actually pay taxes.
I'm sure when challenging one to find the amounts paid to the SELC thugs you know that is not available info ..... Don't you Dennis?

Keep on talking about all the voodoo stuff you want because it simply is not true, but quite humorous.

You do know you all won one a while back and your lawyers collected their money from the gubment?

Yes, Thanks Sea Oat.
It's just that a certain poster here (Of late) seems to think that the prevailing party's legal fees are not paid for by the losing side. He believes that obfuscation of the facts is the way to promote his point of view and agenda. When everybody else of right mind knows otherwise. He keeps pushing ME to prove otherwise, while I have first hand knowledge that he is incorrect.

RE: Vandals at CHNS Cape Point Campground

Squid, he's wrong, we all know he's wrong, and if Derb Carter told him he was wrong, he wouldn't believe it. Arguing only gives him credibility. Present the facts, and let it go.

RE: Vandals at CHNS Cape Point Campground

Recently, after hearing a young SELC lawyer make his statement, I asked him why he was leaving before listening to those who his lies were impacting at this particular hearing. He said he had simply been sent to make a statement. I pushed him a bit further but found his $1000.00 suit to be very empty. It was obvious that he was uncomfortable with the working class folks who were there pleading for some common sense regarding their abilities to make a living and feed their families. It was the classic young twit in his BMW vs the ferry and camp ground operators in their pickups. I try my best, after years of experience, not to stereotype - but I couldn't help but draw my conclusions about who represented substance and who represented hype.

It's plain obvious to everybody whom has paid attention to legal proceedings that if the prosecution prevails, the defense pays the legal fees for the proceedings. Where have you been, living in a cage? You can't make things up and believe they will become truth if you keep saying them enough.
You must have graduated from the Brian Williams School of Blogging. Heck, you must have been at the head of the class.

Bravo ... I saw your tactics at the RegNeg meetings time after time ... try and intimidate those who disagree with you. FYI it did not work then and it will not work now. I am surprised that the SELC lawyer said anything at all to your "push"

Squishy,

Ya have been watching too much of Judge Judy. With all your legal experience it should be easy to prove me wrong ... that is if I was wrong, which I am not! Laughing smiley

You never saw me or my tactics at any reg neg meetings. And he did have difficulty responding to my question - apparently scared of a senior citizen! His inability to listen to the viewpoints of others reminded me of a certain inept judge we all know and love.

Want to bet?
Go get a Lexus law account and look over the Civil case docket of the US eastern District court and request the attorney allowances for the case.
The DoW and SELC are paid for ALL legal fees they incurred in the lawsuit to include the continued "monitoring" of the case. Other than visit the court for 4 years the only monitoring they have done is endorse the DOI/NPS report as presented to judge Boyle with no work on their own.
If they sue and win nothing the Attorney fees are written off as a donation to the non-profit and the attorney continues the same thing with a tax write off at the end of the year. If they win then the get the real dollar amount they want to bill the court since it is court fees there is no list of what they are paid in case review.
For further reading look at how "sue and settle" has skyrocketed in the federal system in the last 11 years.

BS,
Actually Biggest Squid the playing field is quite level despite what clothes  you wear or the car you assume the young attorney was driving I feel pretty confident that the DC lawyers  (that the non profit org CHAPA and Dare county paid for)  salaries were fully commensurate (or better) than the Enviro's lawyer salaries.
What about national groups like, Americans for Prosperity,   A non profit orgs with a different focus than Defenders, is their advocacy ok just because they might have the same values as you? Or do they too have a bunch fancy dressed lawyers driving imported German cars chasing money, working for them?

And there is no doubt in my mind the people who start off, "I don't stereotype people" most certainly do. Just what does a regular Joe know about $1000.00 suits? I couldn't pick one out is my life depended on it. Maybe the young lawyer just didn't want to be stereotyped or insulted leaving the courtroom. I doubt you would call him "pond scum" to his face, but then again who knows?

This whole lawyer suing just for money is a pitifully bad argument. Now I know you don't see it (few do) but for me you have hypocrisy stamped on just about everything you post
